The Teachers’ Bill of Rights
One of the two new Alabama bills, described in the press report as a Teachers’ Bill of Rights, requires school administrators to document the discipline they impose before sending a student back to the K-12 classroom from which the teacher removed the student. The problem the bill addresses is the need for better, more consistent, and more effective student discipline.
Teachers and their union advocates report unprecedented issues with student discipline and teacher retention, affecting both instruction and adequate staffing at Alabama schools. The Students’ Bill of Rights
The other of the two new Alabama bills, described in another press report as making it harder to kick students out of school, requires Alabama K-12 schools to grant students due process rights before kicking them out of school.
The Students’ Rights Bill guarantees that students accused of misconduct and facing school suspension will receive fair notice of the disciplinary charges and evidence. It also guarantees the accused student the right to a hearing to which they may bring an attorney to assist them. Legislators believe that the bill should keep more students in school whom administrators would have otherwise unwisely or unnecessarily suspended.
The Tension the Competing Bills Reflect
If the new laws work, both results, better discipline, and fewer unnecessary suspensions, would be laudable. But it doesn’t take a legal giant to see that the two new laws may conflict. The teachers clearly want and deserve more student discipline. Their Teachers’ Bill of Rights holds administrators accountable for recording and reporting the discipline without simply sending the accused student back to class.
